These Terms and Conditions shall (as modified and amended from time to time, collectively referred to as “Terms and Conditions”) applicable to the Services (hereinafter defined) rendered through accessing/using careers360.lk (hereinafter shall be referred to as the “Site”), are binding on Azend Technologies Pvt. Limited (“AzendTech” or “We” or “Us”) and the job seekers/ recruiters (“You”).
By accessing or using the Site in any manner, including, but not limited to, visiting, or browsing the Site or by contributing content or other materials to the Site (“Services”), you agree to be bound by these Terms & Conditions.
Job seekers and recruiters are responsible in ensuring that the advertising content, texts, images, graphics, curriculum vitae (cv), video (hereinafter collectively referred to as "Content") uploaded for inclusion on the Site comply with all applicable laws. Careers360.lk assumes no responsibility for any illegality or any inaccuracy of the Content.
Job seekers and recruiters hereby guarantee that the Content uploaded to the Site does not violate any copyright, intellectual property rights, or other rights of any person or entity, and further agree to indemnify Us in respect of all loss incurred related thereto. You hereby agree to release Us from all obligations, liabilities, and claims arising in connection with the use of (or the inability to use) the service.
Unless otherwise expressly stated herein, We own the intellectual property rights for all material on the Site. All intellectual property rights are reserved. You may view and/or print pages from Site subject to restrictions set in these Terms and Conditions. Notwithstanding the above, You shall not:
- republish material from the Site;
- sell, rent, or sub-license material from the Site;
- reproduce, duplicate, or copy material from the Site;
- view, extract or copy material for competitive purposes; and
- redistribute Content from the Site (unless content is specifically intended for redistribution).
The Site and its Content, features, and functionality are owned by AzendTech and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
In addition to other prohibitions as outlined in the Terms and Conditions, You are prohibited from using the Site or its Content:
- for any unlawful purpose;
- to solicit others to perform or participate in any unlawful acts;
- to violate any national, international, provincial or local regulations, rules, laws, or local ordinances;
- to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
- to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
- to submit false or misleading information;
- to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or
- operation of the Service or of any related website, other websites, or the internet;
- to collect or track the personal information of others;
- to spam, phish, pharm, pretext, spider, crawl, or scrape;
- for any obscene or immoral purpose; or
- to interfere with or circumvent the security features of the Site or any related website, other websites, or the internet. We reserve the right to terminate your use of the Site or any related website for violating any of the prohibited uses and will result in legal action taken.
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with You. All provisions of this Terms and Conditions shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Some services of the Site require payment, including but not limited to, candidate premier accounts, posting of job advertisements, and ad promotions.
Under no circumstances we shall be obliged to refund any payments made in respect to the paid services.

In some areas of our Site, We request or may request that you provide personal information, including your name, address, e-mail address, telephone number, credit card number, National Identity Card number, Passport details, contact information, and any other information from which your identity is discernible. In other areas, this Site collects or may collect demographic information that is not unique to you such as your age, preferences, gender, and interests.

Moreover, information about your computer hardware and software is or may be collected by this Site. We use the information we gather on this Site, whether personal, demographic, collective or technical, for the purpose of operating and improving the Site, fostering a positive user experience, and delivering the products and services that we offer.
Should you consent, We shall use your contact information in order to send you e-mails or other communications regarding updates at the Site, such as new opportunities and additional listings which may be of interest to you. The nature and frequency of these messages will vary depending upon the information we have about you. You shall be free to opt out from such services at any time.
We have an area where you can submit feedback. Any feedback you submit in this area becomes our property, and upon submission we may use of such feedback (such as success stories) for marketing purposes and/or contact you for further information, subject to the grant of your consent therefor which you are entitled to withdraw.

We authorize You, subject to these Terms and Conditions, to access and use the Site and Content thereon and to download and print a single copy of the Content available on Site subject to these Terms and Conditions. The compilation (meaning the collection, arrangement, and assembly) of all content on the Site is the exclusive property of AzendTech and is protected by copyright, trademark, and other laws. Unauthorized use of the Site Content may violate these laws and/or applicable communications regulations and statutes and is strictly prohibited. You must preserve all copyright, trademark, service mark and other proprietary notices contained in the original Content on any authorized copy you make out of the Content.
Any code that Site creates to generate or display any content or the pages making up any Site site is also protected by Site copyright and you may not copy or adapt such code.
You agree not to sell or modify the Site Content or reproduce, display, publicly perform, distribute, or otherwise use the Site Content in a manner not authorised by these Terms and Conditions, in connection with products or services that are not those of the Site, in any other manner that is likely to cause confusion among consumers, that disparages or discredits Site or its licensees, that dilutes the strength of Site or its licensees's property, or that otherwise infringes Site's or its licensees's intellectual property rights.
You further agree to in no other way misuse Site Content. The use of the Site Content on any other application, website or in a networked computer environment for any purpose is prohibited. Any code that Site creates to generate or display any Site Content or the pages making up any application or service is also protected by Site's copyright and you may not copy or adapt such code.
You hereby agree to indemnify us for any losses or damages that may arise in connection with the breach of erm and Conditions set out herein.

Examples may include hosting our web servers, analyzing data, providing marketing assistance, processing credit card payments, and providing customer service. These companies and individuals will have access to your personal information as necessary to perform their functions, but they may not share that information with any other third party.
We may disclose such information if legally required to do so in compliance with the Personal Data Protection Act No. 9 of 2022.
Since this Site is a career oriented Site, we give you the option of uploading your resume in our database upon the grant of your consent therefor which you are entitled to withdraw. As your resume is searchable, all parties with access to our searchable resume database will have access to certain parts or all parts of your resume.

You may review, correct, update or change your account profile information at any time. Simply log into your account, go to your Profile, review your account information and, if you wish, edit it with the options provided.

If you previously opted not to receive such communications, you may later opt-in by editing your Account Profile.

Thus it is agreed by and between the Parties that We shall not be held liable for any such losses or damages suffered by you or by any third party to the maximum extent permissible under the law, except due to our wilful misconduct or gross negligence.
We reserve the right to modify these Terms and Conditions. Such modifications shall be effective immediately upon posting on Site. You are responsible for the reviewing of such modifications and you shall be given the opportunity to provide your consent for any alterations that affect the manner in which your data is being processed which you are entitled to withdraw. Your continued access or use of Site shall be deemed your acceptance of the modified terms and conditions.
These Terms and Conditions shall be executed by the Parties hereto in good faith, and in case any dispute occurs concerning the interpretation or performance of this Agreement, such matter shall be settled through consultation of the Parties amicably.
In the event an amicable settlement is not reached, the courts within Sri Lanka shall have exclusive jurisdiction to adjudicate any dispute arising out of these Terms and Conditions.
